Terms & Conditions

  • These are our current Terms and Conditions and supersede any previous versions.

  • Only registered customers can place an order.

  • Orders must be confirmed in writing or by email. Placing of an order confirms acceptance of these Terms and Conditions.

  • All orders are taken on a first come, first served basis.

  • On occasion Kimberley Nurseries Ltd will substitute a variety of plant if it is not available. The substitution will be a similar variety and cost. If you do not want Kimberley Nurseries Ltd to substitute, please let us know upon ordering.

  • Prices exclude VAT which will be added at the appropriate amount.

  • All goods and plants remain the property of Kimberley Nurseries Ltd until paid for in full. The risk on the goods is transferred to the customer on collection/delivery.

  • Delivery will be charged at our published rate at the time of ordering.

  • New customers will be asked to pay in advance until we form a working relationship and the relevant checks have been made.

  • Non credit account customers must pay for orders prior to collection or delivery. Delivery will not be arranged until the invoice has been settled.

  • Invoices must be settled by card or BACS payment to Kimberley Nurseries Ltd, Account Number 72148144, Sort Code 51-61-18.

  • All outstanding invoices will be deemed as unpaid and interest will be at at the standard interest rate as published by Barclays Bank Plc plus 8%. Kimberley Nurseries Ltd reserve the right to recover all reasonable costs and expenses if action is necessary to recover invoice debts.

  • Kimberley Nurseries Ltd reserve the right to increase the price of our plants to reflect any increased/additional costs and notification will be sent prior to collection/delivery.

  • In the event of abnormal conditions which make it impossible to carry out a delivery, Kimberley Nurseries Ltd reserve the right to cancel the delivery without notice or incurring any liability.

  • It is the customer’s responsibility to check all deliveries and collections. Any shortages or damages must be reported before the driver leaves the point of delivery or, in the case of collection, the customer leaves the nursery. Errors cannot be corrected at a later date.

  • All plants are checked prior to delivery or collection and are, to the best of Kimberley Nurseries knowledge, delivered in good health. Once the plants have been accepted and signed for and our outside our control, Kimberley Nurseries Ltd accept no responsibility or liability for any subsequent infection or symptoms that develop on the plant or any other issues that may arise.

  • Any plant that is a ‘Special Order’, sourced from another grower, is non returnable or refundable.
